Terms of Service

These Terms govern your use of Textopsy. If you do not agree, do not use the service.

1. Acceptance and Eligibility

By accessing or using Textopsy, you agree to these Terms and our Privacy Policy. You represent that you are at least 18 years old (or legal age of majority in your jurisdiction) and able to form a binding agreement.

2. Service Description

Textopsy provides AI-generated relationship analysis and entertainment content based on chat exports and related inputs. Output may be inaccurate, incomplete, offensive, or unsuitable for your specific circumstances.

Textopsy is for entertainment and informational use only. It is not therapy, medical advice, legal advice, financial advice, or safety guidance.

3. User Content and Permissions

You are solely responsible for content you upload, share, or submit. You represent and warrant that you have all rights, permissions, and lawful basis required to provide that content to us for processing.

You grant Textopsy a worldwide, non-exclusive, royalty-free license to host, process, transform, and analyze your submitted content for operating, securing, improving, and enforcing the service.

4. Prohibited Conduct

  • Do not use Textopsy to harass, threaten, defame, or impersonate others.
  • Do not upload unlawful, infringing, or non-consensual content.
  • Do not attempt to reverse engineer, scrape, overload, or bypass safeguards.
  • Do not use output as a basis for abuse, stalking, or discrimination.

We may suspend or terminate access, remove content, and cooperate with legal requests where appropriate.

5. Payments, Pricing, and Refunds

Paid features are processed through third-party payment providers (such as Stripe). You authorize charges for selected services and applicable taxes/fees.

Pricing may vary by region and may change at any time. Unless required by law, payments are non-refundable, including for dissatisfaction with tone, style, or subjective output.

We may deny, cancel, or reverse transactions where fraud, abuse, risk, or technical errors are detected.

6. Availability and Modifications

We may modify, suspend, or discontinue features at any time, with or without notice. We do not guarantee uninterrupted availability, compatibility, or preservation of content.

7. Intellectual Property

Textopsy branding, code, interfaces, and service materials are owned by us or our licensors and protected by applicable law. These Terms grant no ownership rights to you.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, OR RELIABILITY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXTOPSY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO TEXTOPSY IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

10. Indemnification

You agree to defend, indemnify, and hold harmless Textopsy and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the service, or your breach of these Terms.

11. Dispute Resolution; Class Action Waiver

Before filing a claim, you agree to contact us at contact@textopsy.com and attempt informal resolution for 30 days.

To the extent permitted by law, unresolved disputes will be resolved by binding individual arbitration under commercially reasonable arbitration rules, and not in court, except that either party may bring eligible claims in small claims court.

YOU AND TEXTOPSY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION.

If class action waiver or arbitration is unenforceable in your jurisdiction, disputes must still proceed on an individual basis to the extent permitted by law.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict of law rules, except where mandatory local consumer law requires otherwise.

13. Termination

We may suspend or terminate your access immediately if we reasonably believe you violate these Terms, create legal risk, or harm users, systems, or third parties.

14. Changes to Terms

We may update these Terms at any time. Continued use after posted changes means you accept the revised Terms.
